Welcome to FocusQuest Publishing, the online platform and service provided by FocusQuest Publishing and its affiliates (“FocusQuest Publishing,” “we,” or “us”). This page outlines the terms governing your use of our service. By accessing or using the FocusQuest Publishing services, website, and software provided through or in connection with the service (“Service”), you agree on behalf of yourself and all members of your household and others who use this Service under your account (“you” or “your”) to be bound by this Terms of Use Agreement, the FocusQuest Publishing Privacy Policy, and the other applicable rules, policies, and terms posted on the focusquestpublishing.com website or provided with the Service (collectively, this “Agreement”), regardless of whether you are a registered user of our Service.

We reserve the right to amend this Agreement at any time at our sole discretion by posting the revised Agreement on the focusquestpublishing.com website. Your continued use of the Service after any such changes constitutes your acceptance of the revised Agreement. This Agreement applies to all visitors, users, and others who access the Service (“Users”).

1. Use of Our Service

FocusQuest Publishing provides a platform for you to explore, organize, and discuss books with friends and our community.

Registration: While visiting FocusQuest Publishing does not require registration, certain features such as creating posting book reviews, and commenting on other members’ reviews require you to register with FocusQuest Publishing. Your account gives you access to the services and functionality that we may establish and maintain from time to time at our sole discretion.

Account Security: You are responsible for maintaining the confidentiality of your account and password, as well as restricting access to your account. Notify FocusQuest Publishing immediately of any security breach or unauthorized use of your account.

Communication Settings: You can control your profile and communication settings on your My Account page. By providing FocusQuest Publishing your email address, you consent to us using the email address in accordance with our Privacy Policy.

License: Subject to your compliance with this Agreement and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of the Service.

Unsolicited Communications: To prevent unsolicited advertising or solicitation, FocusQuest Publishing reserves the right to limit the number of communications a Member may send to other Members in any 24-hour period, as deemed appropriate in our sole discretion.

Termination: FocusQuest Publishing may terminate, suspend, or refuse access to the Service without notice and liability for any reason, including violation of this Agreement, or for no reason. Upon termination, you remain bound by this Agreement.

Service Interruptions: The Service is subject to scheduled and unscheduled interruptions. FocusQuest Publishing is not liable for any interruption, delay, or failure to perform.

Interactions: You are solely responsible for interactions with other FocusQuest Publishing Users. We have the right, but no obligation, to monitor disputes between you and other Users, with no liability for your interactions with other Users.

2. User Content

Some Service areas allow Users to post reviews, comments, questions, highlights, and other information (“User Content”). You are responsible for your User Content and agree not to post illegal, obscene, threatening, defamatory, or objectionable content. FocusQuest Publishing may monitor, reject, and/or remove User Content at any time.

User Content Responsibility: You are responsible for your User Content, and any loss or damage resulting from its use. FocusQuest Publishing is not responsible for public display or misuse of your User Content. We provide tools for User Content removal but do not guarantee removal of all User Content.

3. License Grant

By posting User Content, you grant FocusQuest Publishing a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works, distribute, and display such content worldwide in any media. You represent that you own or have the legal right to post the User Content.

4. Our Proprietary Rights

Except for User Content, all materials on the Service are the exclusive property of FocusQuest Publishing and its licensors. You may not sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, or create derivative works from Service materials without our express written consent.

Ideas Submission: By submitting Ideas about the Service, you agree that your disclosure is gratuitous and without restriction. FocusQuest Publishing is free to use Ideas without additional compensation.

5. Eligibility

The Service is intended for Users aged thirteen (13) or older. Use by anyone under 13 is unauthorized. Users under 18 must have parental consent. By using the Service, you affirm you meet eligibility criteria.

6. Paid Services

Billing Policies: Some aspects of the Service may require a fee. Fees, if any, are described on the website. By using paid aspects, you agree to pricing, payment, and billing policies posted on the website.

No Refunds: No refunds are provided for cancellations. FocusQuest Publishing reserves the right to suspend or terminate Accounts at any time without notice or refund.

7. Copyright Complaints

If you believe your copyrighted work is accessible via the Service in a way that constitutes infringement, please provide specified information to FocusQuest Publishing’s Copyright Agent.

8. Third-Party Websites, Advertisers, or Services

FocusQuest Publishing may link to third-party websites or services not owned or controlled by FocusQuest Publishing. We assume no responsibility for third-party content or practices. Your use of third-party sites is at your own risk.

Dealing with Advertisers: Dealings with advertisers found on FocusQuest Publishing are solely between you and advertisers. FocusQuest Publishing is not responsible for any loss or damage relating to such dealings.

9. Indemnity

You agree to defend, indemnify, and hold harmless FocusQuest Publishing and its affiliates from any claims, damages, liabilities, costs, or expenses arising from your use of the Service, violation of this Agreement, or infringement of third-party rights.

10. Disclaimers of Warranties and Limitation of Liability

THE SERVICE AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. FOCUSQUEST MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICE, OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE, UNLESS OTHERWISE SPECIFIED IN WRITING. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, FOCUSQUEST PUBLISHING DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. FOCUSQUEST PUBLISHING DOES NOT WARRANT THAT THE SERVICE, INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE, FOCUSQUEST PUBLISHING’S SERVERS OR ELECTRONIC COMMUNICATIONS SENT FROM FOCUSQUEST PUBLISHING ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. FOCUSQUEST PUBLISHING WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THE SERVICE, OR FROM ANY INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

Assignment: This Agreement may not be transferred by you but may be assigned by FocusQuest Publishing without restriction.

Disputes: Any dispute is subject to the dispute resolution, governing law, disclaimer of warranties, limitation of liability, and all terms in the Amazon.com Conditions of Use.

No Waiver: No waiver of any term shall be deemed a further waiver. FocusQuest Publishing’s failure to assert rights under this Agreement does not constitute a waiver.
